Danny Rodriguez, producer
of the film THE DEVIL INSIDE, and myself, the film’s Associate Producer,
have been in this section of your Newsletter sharing our joys and
pains that we went through the production in order to share also
the lessons learned. For previous installments of these chats, please
visit the NALIP website looking for the archives of the Newsletter.
Word of caution: in order to keep it as honest and open as they
can be, Danny and I have agreed not to edit the substance of our
chats, so they are full of typos and sometimes contain profanity.

and still dealing with this white-man-invention called DSL

tracking cookies, etc. etc. etc.

DannyRodriguez03: it hurt more back in
pre production as you might know
AlexMend: I'm not an anchorman but have
played one in tv
DannyRodriguez03: and you’re not much of
a comedian also so don’t play it on LITI
AlexMend: i know but our readers not, so
let me give them a primer on it
AlexMend: if you don't know, SAG (Screen
Actors Guild, for the novatos)
AlexMend: has several levels of agreements
that a producer can sign into to be able to use a SAG member
AlexMend: in between them is the BASIC
agreement (think expensive), the LOW BUDGET agreement (think less
expensive), the EXPERIMENTAL (think non-commercial) and the STUDENT
FILM one (think... well student film)
DannyRodriguez03: don’t forget the Modified
low budget agreement
AlexMend: under the basic agreement SAG
forces a high minimum scale per day besides high royalties and benefits
to be paid by the producers
DannyRodriguez03: and everyone must be
sag
AlexMend: usually all productions, certainly
those by the studios, fall into this
AlexMend: then there is the MODIFIED low
budget, which most indie films fall into
AlexMend: so here comes Danny... with his
micro budget, already with commitments by two or three SAG members,
one of them a recognizable and very marketable star to request a
Modified low budget agreement...
AlexMend: and...
AlexMend: [that is your cue, stupid]
DannyRodriguez03: ohhhh....
DannyRodriguez03: i felt sleep through
your sag 101 class
AlexMend: we could have use it then...
DannyRodriguez03: so i apply for a modified
low budget agreement
DannyRodriguez03: and the answer it’s a
big NO
AlexMend: why?
DannyRodriguez03: because i was shooting
in Mexico
DannyRodriguez03: the modified agreement
its a privilege given to filmmakers in the U.S.
DannyRodriguez03: so they said
AlexMend: but u are a US filmmaker
DannyRodriguez03: right, but the production
must be done in the U.S.
DannyRodriguez03: i guess to keep jobs
in the U.S.?
DannyRodriguez03: wrong again.........my
crew was from the U.S.
DannyRodriguez03: all my actors were from
the U.S.
AlexMend: but what was wrong then?
DannyRodriguez03: they just did not want
to let me do the modified
DannyRodriguez03: they wanted me to do
the basic agreement
AlexMend: didn't want? Or couldn't?
DannyRodriguez03: you tell me.........i
still don’t know. We applied for an exception
AlexMend: an exception to what?
AlexMend: don't tell me since i have expected
for you to mention it first but you are sloooooow this morning
AlexMend: RULE NUMBER ONE!!!!
DannyRodriguez03: ??????
DannyRodriguez03: haven’t had my cafecito
AlexMend: and u may ask, my novato reader, what is RULE
NUMBER ONE!!!
AlexMend: danny... please explain rule

AlexMend: the readers need to know that
i have danny on the phone asking me WHAT"S IS RULE NUMBER ONE!!!!
AlexMend: ok i guess he didn't learn this
one
DannyRodriguez03: enlighten me
DannyRodriguez03: obbie wan
AlexMend: RULE NUMBER ONE is the one that
says: Any guild member that gets hired to work overseas must be
signed under the BASIC agreement guaranteeing him/her the minimum
scale, royalties and benefits under it
DannyRodriguez03: ohhhhhhhh
DannyRodriguez03: readers should also know
that it is called "Global Rule one"
AlexMend: so this will have forced danny
(well his company) to sign the BASIC agreement that calls for a
minimum scale of... (danny, so you don't look that bad, can you
answer...)
AlexMend: oh so now YOU are the smart one
DannyRodriguez03: $590 p day
DannyRodriguez03: you should work on the
right terminology
AlexMend: what that will jump your budget
to?
DannyRodriguez03: right
DannyRodriguez03: it would jump it to over
budget
DannyRodriguez03: to no budget
AlexMend: what is the MODIFIED low budget
scale?
DannyRodriguez03: $240
DannyRodriguez03: or something close to
that
AlexMend: BIIIGGG DIFFERENCE!
AlexMend: so what you did FIRST
DannyRodriguez03: i opened up a Mexican
production company
DannyRodriguez03: with a mexican address
and phone #
AlexMend: shit man you just gave out the
punch line!
AlexMend: where is the suspense building?
DannyRodriguez03: you’re dragging it
DannyRodriguez03: after i did that
DannyRodriguez03: i re applied and called
it a Mexican production
AlexMend: and mexican companies are not
bounded by GLOBAL RULE ONE?
DannyRodriguez03: yeah.....but i would
only have to pay scale to the sag actors and not to the whole cast
as the basic agreement calls for
DannyRodriguez03: and I was already paying
above scale to danny trejo, sara downing
DannyRodriguez03: so i got the approval
2 or 3 days before heading to mexico
AlexMend: since you already gave the punch
line, let's jump back somewhat to tell our readers another thing
we Learned in the process of dealing with SAG
AlexMend: Insert FLASHBACK
AlexMend: to our readers: regardless of
the lack of writing skills of our guest, there was a substantial
period of time that danny and i worked on this issue
AlexMend: with a lot of stress and pain
in between in which at times my dear friend was about to pull the
plug
DannyRodriguez03: true
DannyRodriguez03: it seemed that they were
against us
AlexMend: we called upon some very BIG
WIGS relationships to come to help
AlexMend: we gathered help from every corner
we could
AlexMend: phone calls and screaming matches
happened
AlexMend: a Major Latino Organization wanted
to make of this an issue for the benefit of other productions
AlexMend: we were wanting someone to make
SAG understand that their position was detrimental to small Latino
productions
AlexMend: but the battle promised to be
long and hard
AlexMend: we just didn't have the time
for the fight as much as Danny was ready to bring them to the mat
AlexMend: then...
AlexMend: between all the people trying
to help (names of people and organizations withheld to protect the
well intentioned but ineffectual) the answer came…
AlexMend: DO IT THE MEXICAN (Literally)
WAY!!!
AlexMend: Go around them
AlexMend: danny, is this a fair assessment?
DannyRodriguez03: you nailed it
AlexMend: so what we learned...
AlexMend: first: DO NOT PUSH, nobody can
push you if you do not push back, JUST GO AROUND!!!!
AlexMend: second: DO NOT ASSUME THAT BECAUSE
YOU HAVE POWERFUL FRIENDS, you can get away with anything you may
desire...
AlexMend: there will be always someone
more powerful
AlexMend: there you go, two more lessons
to be learned, and two merry men on their way to paradise to do
what they love to do the most...

is coming up and I wanted to say how important these conferences
are, without them, there would not be a "DEVIL INSIDE" since I met
Alex at the conference in san diego 5 years ago, where i also met
Elika Crespo in san diego......I also met a couple of crew members
like Alex Cortez...so just a little plug for NALIP....conferences
are a good way to be inspired and build a team of good people
